2. Scope of Services

Lumière Beauty Atelier provides professional makeup services, which may include, without limitation:

• Bridal Makeup
• Special Event Makeup
• Editorial and Photoshoot Makeup
• Makeup Lessons and Personal Consultations
• Airbrush Makeup Application
• On-Location Makeup Services

Service details, timing, availability, pricing, travel fees, trial sessions, and any add-on services will be communicated at the time of inquiry or booking and may vary depending on the nature of the appointment, location, and requested service package.

We reserve the right to refuse, modify, suspend, or discontinue any service where necessary for safety, scheduling, legal compliance, or operational reasons.

3. User Obligations and Responsibilities

By booking or receiving services from Lumière Beauty Atelier, you agree to:

• Provide accurate, complete, and current information when making a booking or consultation request.
• Arrive on time and be prepared for the scheduled appointment.
• Disclose any known allergies, skin sensitivities, medical conditions, recent cosmetic procedures, or other relevant concerns before the service begins.
• Follow all pre-service instructions, including skin preparation guidelines, if provided.
• Ensure that minors are accompanied by a parent or legal guardian where applicable.
• Maintain respectful conduct toward our staff, contractors, and other clients.
• Provide a safe, sanitary, and suitable environment for on-location services, including adequate lighting, seating, and workspace.
• Obtain any necessary permissions, venue approvals, or access arrangements for on-location appointments.

You acknowledge that makeup services may involve the use of cosmetic products, tools, adhesives, and other materials that can cause irritation or allergic reactions in some individuals. You are responsible for informing us of any concerns before treatment. If you fail to disclose relevant information, Lumière Beauty Atelier will not be responsible for resulting adverse effects to the extent permitted by law.

4. Payment Terms and Conditions

All fees, deposits, taxes, travel charges, and other applicable costs will be disclosed prior to or at the time of booking. Prices are subject to change without notice until a booking is confirmed.

• Deposits: A non-refundable deposit may be required to secure an appointment or event date.
• Balance Due: Unless otherwise agreed in writing, the remaining balance must be paid in full on or before the appointment date.
• Accepted Payment Methods: Payment methods accepted will be communicated at booking and may include e-transfer, credit card, debit, or other approved methods.
• Late Payments: We may refuse to provide services if payment is not received by the required deadline.
• Taxes: Applicable federal and provincial taxes will be added where required by law.
• Travel and Additional Fees: On-location services may include travel fees, parking, tolls, early-morning fees, holiday surcharges, or additional artist fees, as applicable and disclosed in advance.

Any chargebacks, payment disputes, or reversed transactions may result in suspension of services and recovery of administrative or collection costs to the extent permitted by applicable law.

5. Cancellation and Refund Policy

We understand that plans may change. However, cancellations and rescheduling affect our availability and business operations. The following policy applies unless a separate written agreement states otherwise:

• Client Cancellations: Cancellations must be made in writing by email to [email protected].
• Deposits: Deposits are non-refundable unless otherwise required by applicable law or expressly stated in writing.
• Rescheduling: Rescheduling requests are subject to availability and may require a new deposit or fee if the original date cannot be rebooked.
• Late Arrivals: If you arrive late, service time may be shortened to avoid affecting subsequent appointments. Full payment remains due.
• No-Shows: Failure to attend a scheduled appointment without notice may result in forfeiture of deposits and/or full service fees, where permitted by law.
• Our Cancellations: If Lumière Beauty Atelier must cancel due to illness, emergency, unsafe conditions, or force majeure, we will make reasonable efforts to reschedule or provide a refund of amounts paid for services not rendered, subject to applicable law and any non-recoverable third-party costs already incurred.

Refunds, if approved, will be issued using the original payment method where reasonably possible. Processing times may vary depending on the payment provider.

6. Liability Limitations

To the fullest extent permitted by applicable Canadian law, including the laws of Ontario, Lumière Beauty Atelier shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of opportunity, or loss of goodwill, arising out of or related to the use of our services.

Without limiting the foregoing:

• We do not guarantee that any particular makeup look will be identical to reference images, as results may vary based on skin type, facial features, lighting, products, and other factors.
• We are not responsible for adverse reactions caused by undisclosed allergies, sensitivities, or medical conditions.
• We are not responsible for damage, loss, or delays caused by third parties, venues, transportation issues, weather, or events beyond our reasonable control.
• Our total liability for any claim arising from or related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim, except where such limitation is prohibited by law.

Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for gross negligence, wilful misconduct, or other non-excludable obligations.

7. Intellectual Property Rights

All content created, owned, or used by Lumière Beauty Atelier, including but not limited to text, branding, logos, service descriptions, photographs, videos, training materials, website content, and promotional materials, is protected by applicable intellectual property laws and remains the property of Lumière Beauty Atelier or its licensors unless otherwise agreed in writing.

You may not copy, reproduce, modify, distribute, publish, display, or create derivative works from our content without prior written consent, except as permitted by law.

We may photograph, film, or otherwise document completed makeup looks for portfolio, marketing, educational, or social media purposes, subject to applicable privacy laws and any written consent requirements. If you do not wish to be photographed or featured, you must notify us in writing before the service begins.

8. Data Protection and Privacy

Lumière Beauty Atelier collects, uses, stores, and discloses personal information only as necessary to provide services, manage bookings, process payments, communicate with clients, comply with legal obligations, and improve our business operations.

We take reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, disclosure, alteration, or destruction. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

By using our services, you consent to the collection and use of your personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation. 9. Force Majeure

Lumière Beauty Atelier shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, fire, flood, severe weather, power outages, public health emergencies, labour disputes, government actions, transportation disruptions, acts of war, terrorism, or other force majeure events.

If a force majeure event affects a booking, we may, at our discretion, reschedule the service, issue a partial refund for unrendered services, or take other reasonable steps consistent with applicable law and the circumstances.

10. Changes to Terms

We may update or modify these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The revised Terms will be effective when posted or otherwise communicated to you, unless a later effective date is stated.

Your continued use of our services after any changes are made constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

11. Applicable Law and Jurisdiction

These Terms, and any dispute arising out of or relating to them or our services, shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree that the courts located in Toronto, Ontario shall have exclusive jurisdiction over any dispute, claim, or proceeding arising from or related to these Terms or our services, subject to any mandatory consumer protection rights that cannot be waived under applicable law.

13. Severability Clause
